General Terms and Conditions for Ticketcorner Live Club

These Conditions for Ticketcorner Live Club Member (called «Member Conditions» in the following) apply for all Live Club services offered by Ticketcorner AG (called «Ticketcorner» in the following). By using Live Club services, you accept the following conditions without change and in full.
The ticket purchaser accepts that the present terms and conditions were translated from the original German version. In any cases of conflicts between this translated version and the German original version, the German version will be considered.

I. OBJECT

  1. The object of these Member Conditions is the use of Live Club services. Agreement to the Member Conditions is given by the use of the corresponding services. When making use of individual services, the ticket buyer may be asked to confirm his agreement to these Member Conditions by clicking on a corresponding confirmation box.

  2. These Member Conditions apply for the entire period during which the Live Club services are used by the ticket buyer. They automatically become an integral part of the General Terms and Conditions (GTC) agreed between the ticket buyer and Ticketcorner when the Live Club services are used or with the agreement given as in Fig. 1.1..

II. TICKETCORNER LIVE CLUB MEMBERSHIP

  1. General

    Live Club Members benefit from advantages connected with the booking and availability of tickets for certain events marketed by Ticketcorner. The Live Club Members are regularly sent information about the offers provided by Ticketcorner and Live Club.

  2. Purchase of Live Club Membership

    1. Any person capable of action (called the «applicant» or «member» in the following) can submit an application to Ticketcorner for acceptance in the Live Club (called «application» in the following). The application for Live Club Membership is made on the website www.ticketcorner.ch or at one of the order hotlines operated by and for Ticketcorner. Ticketcorner can reject applications without giving reasons.

    2. After the application has been made, Ticketcorner confirms the receipt of the application to the applicant in an automatically generated e-mail. This application is accepted after payment of the membership fee (called «Member Fee» in the following) has been received by Ticketcorner through the sending of a membership number to the applicant. A contract relating to the applicant's Live Club Membership (called «Member Contract») is created between the applicant and Ticketcorner, which includes these Member Conditions and the provisions of the STC.

  3. Duration of Member Contract

    The Member Contract comes into force on the date of the receipt of the buyer’s payment of the Member Fee, and is initially valid for a period of 12 months (called «Contract Year» in the following). Subsequently, the Member Contract is extended automatically for a further contract year at a time, unless the member or Ticketcorner give notice of termination of the Member Contract with a period of notice of 3 months to take effect at the end of the contract year (called «end of contract» in the following) by registered letter or e-mail with confirmation of transmission. The right of both parties to terminate the contract extraordinarily for an important reason is reserved.

  4. Consequences of terminating the Member Contract

    With the termination of the Member Contract, no matter what the reason, the membership lapses and the services of the Memberclub can no longer be used from the end of the contract. There will be no reimbursement of any Member Fee already paid. The member is in addition obliged to return the Membercard (Fig. 3) after the end of the contract immediately to Ticketcorner or to destroy it.

  5. Member Fee

    The Member Fee is payable and due for each contract year in advance. If the member has not yet paid the Member Fee, Ticketcorner has the right to refuse or suspend the provision of the corresponding services until payment has been received. The level of the Member Fee can be seen here. Ticketcorner can change the level of the Member Fee at any time. Ticketcorner will inform the member of any changes by e-mail. The new Member Fee is then applicable from the contract year following the notification of the change. If the Member Fee is increased, the member has the right to terminate the Member Contract to take effect at the end of the ongoing contract year. In this case, notice of termination can be given at any time before the end of the current contract. The period of notice under Fig. 2.3 is not applicable.

III. LIVE CLUB MEMBERCARD

  1. Live Club members receive a Membercard. This is a membership card and will be issued beginning 1/12/2019 exclusively in digital form in the Ticketcorner app under «Live Club». Older, physical Membercards will remain valid. The Membercard allows access through the member entrance at event venues designated by Ticketcorner. The Membercard has an identification code (Member Number). The member is obliged to use the Membercard carefully and solely for his own personal use and in accordance with the provisions of these Member Conditions and the STC. Ticketcorner is entitled to withdraw membership from the member if the Membercard is misused. If it is withdrawn, the Member Fee already paid will not be reimbursed.

  2. The Live Club Member must promptly notify Ticketcorner of the loss of the physical Membercard by registered letter or e-mail with a send confirmation. The digital Membercard in the app can be used as a replacement.

  3. The Ticketcorner Live Club offers can only be booked through personal identification (login, password).

IV. LIVE CLUB MEMBER BONUS

  1. For every ticket order from 1 June 2017 onwards, for as long as they are members, Live Club Members will receive a credit note to their Member Bonus account. The amount is determined by Ticketcorner and can be changed at any time.

  2. The credit balances accumulated in this way will be added up each calendar year. Only ticket orders which are completely executed and paid for within a calendar year will be included in the account settlement. Orders which are only paid for later than 31 December will be included in the following year's calculation.

  3. In the following year, a Member Bonus voucher code will be sent worth the collected amount, up to a maximum amount of CHF 100.–, at a date determined by Ticketcorner.

  4. The Live Club Member can use the received voucher code only for orders at www.ticketcorner.ch. The modalities will be announced with the sending of the voucher code.

  5. Ticketcorner AG (Ticketcorner) is, at its own discretion, entitled at any time to discontinue the Live Club Member Bonus product. The discontinuation of this product is not an important reason to terminate the contract extraordinarily (Fig. 2.3).

  6. However, if there is any suspicion of abuse and/or violation of the conditions of participation, Ticketcorner AG (Ticketcorner) is, at its own discretion, entitled to cancel the Live Club membership and/or to block any Member Bonus vouchers that have not yet been redeemed.

V. FINAL PROVISIONS

  1. Ticketcorner reserves the right to change these Member Conditions at any time. Changes will be published on the Ticketcorner website and come into force as soon as they are published.

  2. If one or several provisions of these Member Conditions are or become invalid or unfeasible in whole or in part, this shall not affect the validity or feasibility of the other provisions of these Member Conditions or the purchase of the ticket. In such case, the parties will replace the invalid or unfeasible provision by a provision that is valid and feasible and that comes as close as possible to the commercial purpose of the provision to be replaced. The same applies correspondingly in the event that there is an omission in these Member Conditions.

  3. These Member Conditions and disputes arising out of or in connection with the relationship between Ticketcorner and the ticket buyer shall be governed solely by Swiss law, to the exclusion of the provisions on the conflict of laws and the provisions of the UN law on the sale of goods (CISG).

  4. The sole legal venue for all disputes between Ticketcorner and the ticket buyer is the registered office of Ticketcorner. Ticketcorner is entitled, however, to take action against the ticket buyer at his domicile.
